Thousands Erroneously Tagged Ineligible to Vote --In New Databases, Many Are Wrongly Flagged as Ineligible 18 Oct 2008 Thousands of voters across the country must reestablish their eligibility in the next three weeks in order for their votes to count on Nov. 4, a result of new state registration systems that are incorrectly rejecting them. In Alabama, scores of voters are being labeled as convicted felons on the basis of incorrect lists. Michigan must restore thousands of names it illegally removed from voter rolls over residency questions, a judge ruled this week. Tens of thousands of voters could be affected in Wisconsin. Officials there admit that their database is wrong one out of five times when it flags voters, sometimes for data discrepancies as small as a middle initial or a typo in a birth date.

Early W.Va. voters angry machines kept switching their votes to GOP candidates --Jackson County touch-screens switched votes, 3 residents say 18 Oct 2008 At least three early voters in Jackson County had a hard time voting for candidates they want to win. Virginia Matheney and Calvin Thomas said touch-screen machines in the county clerk's office in Ripley kept switching their votes from Democratic to Republican candidates. "When I touched the screen for Barack Obama, the check mark moved from his box to the box indicating a vote for John McCain," said Matheney, who lives in Kenna. When she reported the problem, she said, the poll worker in charge "responded that everything was all right." [WHY are these 'voting' machines, aka GOP tools to implement Coup 2008, *still standing?*]

"I pushed buttons and they all came up Republican," she said. "I hit Obama and it switched to McCain. I am really concerned about that. If McCain wins, there was something wrong with the machines." More W.Va. voters say machines are switching votes --In six cases, Democratic votes flipped to GOP 18 Oct 2008 Three Putnam County voters say electronic voting machines changed their votes from Democrats to Republicans when they cast early ballots last week. This is the second West Virginia county where voters have reported this problem. Last week, three voters in Jackson County told The Charleston Gazette their electronic vote for "Barack Obama" kept flipping to "John McCain". In both counties, Republicans are responsible for overseeing elections.

Voters say they were duped into registering as Republicans --YPM, a group hired by the GOP, allegedly deceived Californians who thought they were signing a petition. Similar accusations have been leveled against the company elsewhere. 18 Oct 2008 Dozens of newly minted Republican voters say they were duped into joining the party by a GOP contractor with a trail of fraud complaints stretching across the country. Voters contacted by The Times said they were tricked into switching parties while signing what they believed were petitions for tougher penalties against child molesters [lots of them in the GOP, btw.]. Some said they were told that they had to become Republicans to sign the petition, contrary to California initiative law. Others had no idea their registration was being changed.

'Wake up, niggers!' --Locals say the "inciting" language used by the McCain campaign in the past month has emboldened racists to act and speak more openly, leading to outbursts such as "traitor", "terrorist" and "kill him" at campaign events. 19 Oct 2008 In a small town in Oklahoma, not even loyal Democrats will vote for a black man. Kristi Balden woke up at 4.30am to the sound of screeching tyres and yells of "nigger lover!" As she looked out of the window, a vehicle sped away with spinning wheels, peppering her parked car with gravel. She saw her Barack Obama yard sign in shreds on the lawn. It was the fifth time in three weeks her signs backing Obama had been vandalised. Elsewhere in the small town of Enid, in northwestern Oklahoma, more than 50 other residents have had their Obama signs smashed to pieces, and cars with bumper stickers that bear the black presidential candidate’s name have been splattered with eggs. Late one night three weeks ago, four white youths went to a town museum that celebrates minority achievements and took down an exhibit of five Native American teepees. They dragged two of the tents around the streets of an African American neighbourhood, yelling: "Wake up, niggers!"

Death threat, vandalism hit ACORN after accusations 17 Oct 2008 An ACORN community organizer received a death threat and the liberal-leaning voter registration group's Boston and Seattle offices were vandalized Thursday, reflecting mounting [GOP/Nazi] tensions over its role in registering 1.3 million mostly poor and minority Americans to vote next month.

Obama camp calls for special prosecutor in fraud investigation 18 Oct 2008 The Obama campaign announced Friday that it is asking Attorney General Michael Mukasey to turn over any investigations of voter fraud or voter suppression to Special Prosecutor Nora Dannehy. Dannehy is also the special prosecutor recently appointed to investigate the U.S. attorney firing scandal. Bob Bauer, the Obama campaign's general counsel, said on Friday that partisan politics was behind Thursday's leak from senior governmental officials about a preliminary FBI investigation into the voter registration activities of ACORN. "ACORN is a tool for attacking voters," Bauer said.

Bush Declares Exceptions to Sections of Two Bills He Signed Into Law

WASHINGTON — President Bush asserted on Tuesday that he had the executive power to bypass several parts of two bills: a military authorization act and a measure giving inspectors general greater independence from White House control.

Mr. Bush signed the two measures into law. But he then issued a so-called signing statement in which he instructed the executive branch to view parts of each as unconstitutional constraints on presidential power.

In the authorization bill, Mr. Bush challenged four sections. One forbid the money from being used “to exercise United States control of the oil resources of Iraq”; another required negotiations for an agreement by which Iraq would share some of the costs of the American military operations there.

The sections “purport to impose requirements that could inhibit the president’s ability to carry out his constitutional obligations,” including as commander in chief, Mr. Bush wrote.

In the other bill, he raised concerns about two sections that strengthen legal protections against political interference with the internal watchdog officials at each executive agency.

One section gives the inspectors general a right to counsels who report directly to them. But Mr. Bush wrote in his signing statement that such lawyers would be bound to follow the legal interpretations of the politically appointed counsels at each agency.

The other section requires the White House to tell Congress what each inspector general said about the administration’s budget proposal for their offices. Such a requirement, Mr. Bush wrote, would infringe on “the president’s constitutional authority” to decide what to recommend to Congress.

Mr. Bush will not submit another budget request before his administration ends in January, so his objections are unlikely to face a test on his watch. Still, the bill’s sponsor, Representative Jim Cooper, Democrat of Tennessee, said he hoped that the next president would overturn Mr. Bush’s signing statements.

“These things create uncertainty in the law that should not be there,” Mr. Cooper said.

The White House has defended Mr. Bush’s use of signing statements as lawful and appropriate. But in 2006, the American Bar Association called the device “contrary to the rule of law and our constitutional system of separation of powers.”

Mr. Bush has used the signing statements to assert a right to bypass more than 1,100 sections of laws. By comparison, all previous presidents combined challenged about 600 sections of bills.

Tent City Judgement a Revolution Today

In a decision to a case which will be forever after referred to in courts as Victoria Vs Adams, Madam Justice Ross has this morning recognized for the first time in Canadian justice, that homeless people have rights guaranteed under the Canadian constitution, and that policies directed against the poor illegally infringe on those rights.

There is a celebration developing amongst the street community in Victoria and across the nation. Dozens of people have been comong to the lawyers' office and to the lawn of the court house. There is an overall sentiment that there will be tents erected tonight.

The date of this judgement comes exactly three years after the application was first championed by Catherine Boise-Parker and Irene Faulkner. It also falls within the holiday season which is celebrated by the Jewish faith as including Sukkot, a festival of tents in reference to Leviticus 23:41-42 where God commands that seven days be spent living in tents. The judgement coincides with the federal election day as well, but much of the original source of the social movement that brought us this far dates back farther than any of today's administrations.

In 2000-2001, a group became known as the Spiral Islanders, after a protest of a small group of young campers that refused to move along, but were continuously displaced by Christ Church Cathedral, the Province of BC, the Victoria Police Department, The Provincial Capital Comission, the City of Victoria, and many other organizations including even the local media monopolies. The movement gained steam and momentum, grew in numbers, and was invited into a warehouse by Jeweller Rob Lund, only to be cast out again after police forced the landlord to cancel the lease. At one peak of the escalation City Hall was occupied for weeks, and after extreme measures taken by the police which saw at least one homeless activist rail roaded into jail for 3 months and others seriously brutalized, the group moved to the Legislature lawn in solidarity with the Students' Day of Action.

After weeks of occupation, the camp established itself as a truly benevolent community. Hundreds of police moved in and arrested protesters for simply being on the legislature grounds, which at that time was on Songese disputed territory. The Attorney General on both the federal and provincial levels admitted in court that they never had evidence to have made the arrests. The camp was thrown into a dumpster at six in the morning.

One of those arrested, David Arthur Johnston, helped establish a subsequent tent city, this time on the grounds of St. Anne's Accademy, the first Catholic Church in BC. Police and security again used extreme measures, and the campers set up across the street, at Cridge Park, the tent city which became the subject of the case of Victoria Vs. Adams. Campers held on for weeks, but were eventually wiped out. David Johnston continued to return to the gates of St. Anne's, facing whole battalians of security guards hired expressly for the purpose of torturing David, carrying him off the property, threatening him, keeping him awake, and stealing his things. Police drove him repeatedly to the city limits, even in the winter rain, only to have him return again to the gates of St. Anne's. This continued for over two years with David facing longer and longer jail terms through which he refused to eat in custody. Eventually, in what witnesses describe as a totally bogus trial in which Legal Aid seemed to be making arguments for the Crown, David was sentenced to seven months in jail. He was released over a month later trying to hold up his pants while media interviewed him.

There have been thousands of people that have sacrificed so much, especially when they are a people that has so little to sacrifice. Even without food or housing, the people facing basic survival have proven themselves of the highest dignity of humanity. Our society has been created in part by homelessness, in this court case, and now society must account for having ever fought against the rights of the poor in the first place, for having disregarded every broken oath to uphold the constitution. Our society has been found to be unlawfully oppressing the poor, which everyone has always known, but which was officially recognized for the first time this morning, Oct 14th, 2008.
